Terms of Service

These terms govern your use of the GAIN website, enrolment in our programmes, and the purchase and download of digital products from our store. Using the site or making a purchase means you accept them.

The site, the programmes and the store are operated by AYA Labs (company number 558636189), trading as GAIN ("we", "us").

1. Definitions

  • The site - gain-producers.com and all its pages.
  • Programme - a course or workshop led by an instructor, live or recorded.
  • Digital product - a downloadable file, including a sample pack, a preset pack or a plugin.
  • Free product - a digital product given at no charge in exchange for a name and an email address.
  • User - anyone who browses the site, enrols in a programme, or downloads a digital product.

2. What we offer

The site offers three kinds of service, and their terms differ:

  • Programmes - sold in Israeli shekels; access is granted to those who enrol and pay.
  • Paid digital products - bought in the store and delivered as a downloadable file.
  • Free products - given at no charge after you provide a name and an email address.

We may add, change or discontinue any product or programme at any time. Doing so will not take away what someone has already bought - see section 12.

3. Access, personal links and passwords

Access to a product you bought or claimed is given through a personal link sent to the email address you provided. There is no password, so the link itself is the key: whoever holds it can use it.

  • Do not pass a personal link to anyone else or publish it.
  • We may revoke a link that is being abused, including mass sharing.
  • You are responsible for giving a valid email address and keeping access to it.

Giving an email address on a free product form does not create an account and does not grant access to anything that address bought before. A link received for a free product opens that product only.

4. Prices, currency and payment

The binding price is the one shown on the product page at the time of purchase. Different products are sold through different channels and currencies:

  • Programmes - sold in Israeli shekels, including VAT as required by law, through an Israeli payment provider. We are the seller and we issue the invoice.
  • Paid digital products - may be sold in US dollars through Creem, acting as the Merchant of Record for that transaction. Where that applies, Creem is the seller for payment and tax purposes: Creem collects the payment, is responsible for charging VAT or local sales tax in the buyer's country, and issues the receipt or invoice to the buyer. Creem's own terms apply to that transaction in addition to these.

We do not collect or store card details. Payment happens only on the payment provider's page.

5. Delivery

A digital product is delivered immediately after payment is confirmed, as a download link or access on a dedicated page, and also by email. A free product opens for download immediately after the form is submitted.

Where a sale is made through a merchant of record, the download may be provided through that provider's portal, and the buyer receives a link to it by email.

You are responsible for having an internet connection, storage space and suitable software. Any material technical requirement, such as a required software version, is stated on the product page.

6. Your licence to use digital products

Buying or downloading a digital product does not transfer ownership of it to you. We grant you a personal, worldwide, non-exclusive, non-transferable licence, subject to payment and to these terms.

What you may do

  • Use the samples, presets and sounds in your own musical works.
  • Release, distribute and sell those works, including commercially, royalty-free and with nothing further owed to us.
  • Use them in work for a client, as part of a musical work.
  • Install and use the product on your own computers.

What you may not do

  • Sell, rent, share or distribute the files themselves, in whole or in part.
  • Include the files themselves in a sample pack, sound library or other competing product.
  • Upload the files to a file-sharing service, download site or peer-to-peer network.
  • Present the sounds as your own original work while they stand alone.
  • Reverse engineer, decompile or circumvent protection in a plugin.

In short: the music you make is yours; the files remain ours. Breaching the licence terminates it immediately.

7. Intellectual property

All rights in the site, course material, recordings, handouts, samples, presets, software, logo and the GAIN name belong to us or to our licensors. They may not be copied, reproduced, published, translated or made into derivative works, except as expressly permitted in section 6.

Lesson recordings and programme materials are for the enrolled student only. Recording them, screenshotting them for distribution, sharing or uploading them is prohibited.

8. Prohibited use of the site

  • Attempting to reach content you did not buy, including guessing or altering access links.
  • Using an email address that is not yours.
  • Disrupting the site, generating artificial load, automated scraping, or attempting to bypass limits.
  • Using the site for any unlawful or abusive purpose.

We may block access for anyone who breaches this section, without refund.

9. Community

Taking part in our Discord community, or any other community space of ours, is subject to that space's rules. We may remove content or a participant who is abusive, posts spam, or shares programme material. The service is provided by a third party and is also subject to its terms.

10. Cancellations and refunds

The right to cancel, cancellation fees and how refunds are made are set out in our Cancellation Policy, which forms part of these terms.

Please note: a digital product whose access opened immediately on payment cannot be cancelled, under Israeli consumer protection regulations. Where a sale was made through a merchant of record, refund requests are handled with them, and we will help.

11. Privacy

What we collect and how we use it is set out in our Privacy Policy. Submitting a free product form includes consent to receive updates and content from us, and you may withdraw that consent at any time.

12. Warranties and limitation of liability

We work to keep the site and the products functioning properly, but they are provided as they are. We do not warrant that the site will run without interruption or fault, and we are not responsible for a failure caused by an infrastructure provider, a payment provider, or your own equipment or software.

We make no promise of any particular musical, professional or commercial outcome from using our programmes or products.

In any event, our total liability to you will not exceed the amount you actually paid for the product or programme the claim relates to. Nothing here removes rights that cannot be contracted out of under applicable law.

If we discontinue a product or programme, we will make reasonable effort to let those who already bought it download or view the content for a reasonable period beforehand.

13. Changes to these terms

We may update these terms. The updated version will be published on this page with a new date and will apply to use and purchases from that date onward. A change will not apply retroactively to a transaction already completed.

14. Governing law and jurisdiction

These terms are governed by the laws of the State of Israel. The competent courts of the Tel Aviv-Jaffa district have exclusive jurisdiction. Nothing here removes a consumer's right to bring a claim in a court that has jurisdiction under applicable law.
